Terms of Service

These terms govern your use of FieldStack's website and services. By using FieldStack, you agree to these terms.

1. The service

FieldStack provides AI agent services for field service businesses, including but not limited to: AI phone receptionist, automated estimate follow-up, automated review collection, and customer reactivation. Specific services and pricing are described in your order form.

2. Your account and data

You retain ownership of all data you provide to FieldStack and all customer data we process on your behalf. You grant us a limited license to process this data solely to deliver the services you have ordered.

You are responsible for: (a) compliance with applicable laws (TCPA, CAN-SPAM, GDPR where relevant), (b) obtaining consent from your customers to be contacted by AI agents, (c) keeping your account credentials secure, and (d) accurate FSM and integration credentials.

3. Fees and payment

You agree to pay the fees specified in your order form. Install fees are due upon signing. Monthly fees are billed in advance. Pass-through costs (Twilio voice/SMS, etc.) are billed monthly based on actual usage.

Late payments accrue interest at 1.5% per month. We may suspend service for non-payment after 15 days written notice.

4. Cancellation

You may cancel with 30 days written notice. We will export your data, disconnect integrations cleanly, and return phone numbers to your designated carrier. No refunds for install fees (work has been performed). Pro-rated refunds for pre-paid annual fees minus a 10% administrative fee.

5. Acceptable use

You will not use FieldStack to: (a) violate laws or regulations, (b) send unsolicited commercial communications (spam), (c) violate the TCPA or other communication laws, (d) harm or harass any person, (e) reverse engineer or redistribute the service, or (f) circumvent rate limits or security controls.

6. Service levels

We target 99.5% monthly uptime for the FieldStack platform and 99.9% for voice answering specifically. Specific SLA commitments are detailed in your order form for enterprise customers.

7. Warranties and disclaimers

FieldStack is provided "as is" without warranty of any kind, except as expressly stated in your order form. AI agents make probabilistic decisions. While we work hard to make them accurate, you acknowledge that AI may occasionally produce errors.

8. Limitation of liability

To the maximum extent permitted by law, our liability is limited to fees paid in the 12 months preceding the claim. We are not liable for consequential, indirect, or punitive damages including lost profits, lost data, or business interruption.

9. Indemnification

You agree to indemnify FieldStack against claims arising from your use of the service in violation of these terms, your violation of applicable laws, or your violation of third-party rights.

10. Changes to terms

We may update these terms. Material changes will be announced via email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Governing law

These terms are governed by the laws of the State of Georgia, USA. Disputes will be resolved in the state and federal courts of Fulton County, Georgia.
